Arizona DUI
In Arizona, DUI prosecutions result in more trials than all other criminal prosecutions combined. Even for the first offense if you are convicted of DUI you must serve ten days in jail, with a possible nine-day suspension. If your first offense is an "extreme DUI,” where your blood alcohol content exceeds .15, you must serve at least ten days in jail. The consequences of a DUI conviction increase greatly if you have had one or more prior convictions.

DUI Per Se .08
In Arizona, it is “per se,” or automatically, an offense to drive with a blood alcohol concentration (BAC) measured at or above .08. The rationale is that at .08 BAC, all drivers, even experienced drinkers, show impairment in driving ability.
DUI Extreme .15
A conviction of Extreme DUI is considered a misdemeanor criminal conviction. It is illegal for a person to show a BAC of 0.15 or more within two hours of driving or “being in control” of a motor vehicle.
Aggravated DUI
If you have two or more prior DUIs on your record that originated within 60 months from your current Arizona DUI charge, you can be charged with the serious felony of Aggravated DUI. This is a class 4 felony in Arizona, and it leads to a minimum sentence of 4 months in prison. Any DUI charge while you have a suspended or revoked license or when you have a child under the age of 15 in the vehicle also results in a felony Aggravated DUI charge, requiring mandatory imprisonment.
